Section 356 BNS -Whoever, by words either spoken or intended to be read, or by signs or by visible representations, makes or publishes in any manner, any imputation concerning any person intending to harm, or knowing or having reason to believe that such imputation will harm, the reputation of such person, is said, except in the cases hereinafter excepted, to defame that person. Method of Communication: This can be through spoken or written words, signs (gestures), or visible representations like images, cartoons, or social media memes. -Publication: The statement must be “published,” meaning it was communicated to at least one person other than the victim. Private thoughts or one-on-one conversations that no one else hears are not covered. -Reputational Damage: The statement must lower the person’s character (moral or professional) or status in the eyes of right-thinking members of society. -Target Group: It applies to living individuals, but can also extend to deceased persons (if it hurts their family) or entities like companies and associations. If convicted, the punishment is simple imprisonment for up to two years, a fine, or community service.
