If the drawer makes the payment within this 15-day period, no cause of action arises under Section 138. 30 Days – Filing of Complaint If the drawer fails to make payment within the stipulated 15 days, the payee is entitled to file a criminal complaint before the competent Magistrate under Section 138. Such complaint must be filed within 30 days from the expiry of the 15-day period. Legal Consequence: Non-compliance with any of the aforesaid timelines renders the complaint non-maintainable and liable to be dismissed on the ground of limitation.
