If you’ve received a notice under Section 13(4) of the SARFAESI Act, it means the bank intends to take possession of your property due to loan default. Before this, they must have sent a Section 13(2) demand notice giving you 60 days to repay. If you didn’t respond or settle within that time, the bank can now proceed with possession and sale of the property. However, they cannot harass you—any threats, abusive behavior, or illegal recovery actions are against RBI guidelines, and you can file complaints with the police, the bank’s grievance cell, or the Banking Ombudsman. To save your home, you have several options: you can negotiate with the bank for a One-Time Settlement (OTS) or restructuring of the loan, which may stop further recovery action. You also have the legal right to challenge the 13(4) notice in the Debt Recovery Tribunal (DRT) within 45 days. If the bank has made procedural errors, such as improper notice service or incorrect valuation, you can raise these in your defense. Engaging a lawyer experienced in SARFAESI and DRT matters is highly advisable, as they can guide you through negotiations or legal filings. Section 138 NI Act creates a criminal liability for dishonour of cheque due to insufficiency of funds or if the amount exceeds the arrangement made with the bank. Essential Ingredients of Section 138 For an offence under Section 138 to be made out, the following six conditions must be satisfied: Cheque must be drawn by a person on an account maintained by him.
