Episode – Articles 10 & 11 | Citizenship and the Power of Law In this episode of the Constitution series, we look at Articles 10 and 11 of the Constitution of India, which explain how citizenship continues and who controls its rules. Article 10 ensures that anyone recognized as a citizen under the Constitution continues to remain a citizen of India. Citizenship does not randomly disappear once it has been granted under constitutional provisions. Article 11 then gives Parliament the authority to regulate citizenship through laws. This means Parliament has the power to decide how someone can become a citizen, how citizenship can be lost, and how the rules may change in the future. Because of this constitutional power, Parliament later enacted the Citizenship Act, 1955, which explains the legal process of citizenship in India today. Together, Articles 10 and 11 show an important constitutional balance: citizenship is protected by the Constitution but regulated by law.

The Ninth Amendment exists because the founders worried that listing your rights might accidentally limit them. Here's something they don't teach in school: some of the founders didn't want a Bill of Rights at all. Not because they didn't believe in rights. Because they were afraid of what writing them down might do. Alexander Hamilton made the argument. If you write down specific rights, you imply those are the only ones that exist. What about rights you forgot to list? What about rights no one had thought of yet? A list, Hamilton argued, could become a cage. But the Anti-Federalists demanded protections in writing. They didn't trust a government that wouldn't put limits on paper. So James Madison drafted the amendments. And to answer Hamilton's concern, he included the Ninth. "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people." Just because we wrote these down doesn't mean these are the only ones. You have rights beyond this list. The government cannot say, "That right isn't mentioned, so it doesn't exist." The Bill of Rights is a floor, not a ceiling. The founders knew they couldn't anticipate everything. So they wrote an amendment that says: we didn't think of it all. And that's the point. This Convention of States path has never been used before (since the Constitutional establishment in 1787) which is why this moment in history is so significant and worth paying close attention to.
