Another agent told me about buyers who purchased a townhouse in an HOA community. The property was well maintained and the dues were about three hundred dollars per month. During the transaction the buyers requested an estoppel letter. It came back clean with no pending assessments or violations. Their attorney reviewed the HOA documents and everything looked normal. The seller also assured them the community was well run. Closing happened without issues. Two weeks later the buyers received a letter from the HOA. The community had voted months earlier on a special assessment for major repairs. The cost was split among all owners. Each owner owed fifty thousand dollars. Payment was due within ninety days. The buyers were shocked. They contacted the HOA asking why this was not on the estoppel. The HOA explained the vote had happened, but the assessment was not officially levied until two days after closing. The buyers called the seller. He admitted knowing about the vote but said it was not official yet so he did not think it needed to be disclosed. Their attorney disagreed. In Florida, approved special assessments must be disclosed even if not yet levied. The seller knew and failed to inform them. After months of pressure the seller agreed to cover the fifty thousand dollars. But the situation created unnecessary stress and could have been avoided. Always request HOA meeting minutes along with the estoppel. And make sure your contract requires disclosure of any approved assessments, even if not yet levied.
