Just a reminder that the First Amendment protects freedom of speech and expression for everyone, regardless of political party or ideology. It does so by limiting government power. And it should function the same way, no matter who’s in control of the country and no matter who has political power. If there is a bedrock principle underlying the First Amendment, it is that the government may not prohibit the expression of an idea simply because society finds the idea offensive or disagreeable. Certainly, those with different political views may find different ideas or words offensive depending on their personal philosophy. But the First Amendment applies the same, independent of personal perspective or political allegiance. Here’s an example: After the tragic Parkland school shooting, New York’s financial regulator, Linda Lacewell Vullo, encouraged banks and insurance companies to stop doing business with the NRA (National Rifle Association). The NRA sued, arguing this government pressure (jawboning) violated their First Amendment rights. The Supreme Court ruled that Vullo’s actions violated the First Amendment because government officials cannot use coercion or pressure to silence or economically punish groups based on their viewpoints. Government jawboning is a serious free speech violation. NRA v. Vullo stands for the important principle that the First Amendment protects us from indirect government censorship or economic punishment. If you supported that recent decision, you understand why the FCC pressuring ABC to suspend Jimmy Kimmel because of his speech presents constitutional concerns. Even in the face of a school shooting (or violent political assassination), the government cannot bypass constitutional limits by using private actors as proxies to punish or silence dissenting views. The Constitution is not political. It does not favor any party or ideology. It’s a neutral framework that governs how the government operates. It guarantees individual freedoms. And perhaps most importantly, it protects against tyranny — something all Americans should care about, no matter their other beliefs.
