Tried my best to summarize RERA (Real Estate Regulation & Development Act, 2016) in 90 seconds. However, summarizing 92 sections in 90 seconds turned out to be an ambitious task! Therefore i have highlighted the most important section from the home buyer’s perspective. Some of the important sections that i didn’t talk in the video, are as follow: ➡️ Section 6 talks about the extension of the RERA registration for projects due to force majeure (ie: uncontrollable circumstances beyond the promoter’s control such as war, flood, earthquake etc) ➡️ Section 7 talks about how the RERA authority may revoke a project’s RERA registration if the promoter is found guilty of any kind of fraud or unfair trade practices. ➡️ Section 11 further talks about all the various responsibilities of a promoter. ➡️ Section 15 talks about the transfer of a project to a third party. The promoter must take a written consent from atleast two-third allottees and from the RERA authority. ➡️ Section 16 talks about the obligations of a promoter regarding insurance of the real estate project. ➡️ Section 17 talks about how the promoter must transfer the title of the common areas to the association of allottees. ➡️ Section 19 talks about the rights and duties of allottees. ➡️ Sections 59 to 68 talks about the various penalties imposed on builders, agents and allottees in case they fail to comply with orders of the authority. 🚀 Share this with anyone looking to buy a house right now! 🎗️Save this post for later use! #realestate #property

What most people miss is this RERA isn’t one-sided. It protects both ends of the deal ⚖️ RERA Rules Every Buyer & Builder Must Know: 1️⃣ Delay in Possession = Penalty (Section 18) If the builder delays the project, the buyer is entitled to compensation for every month of delay. 2️⃣ Timely Payment is Buyer’s Duty (As per Agreement under RERA) Buyers must make payments as per the agreed schedule, or the builder can take action. 3️⃣ No Changes Without Consent (Section 14) The builder cannot make any structural or layout changes without the buyer’s written consent. #realestatenews #law #fyp

As per section 13 of RERA, promoters cannot accept more than 10% of the cost of the apartment as an advance fee without first registering a written Agreement for Sale with the home buyer. This Agreement for Sale needs to specify the particulars of development of the project including - the construction of building and apartments, along with specifications and internal and external development works, the dates and the manner by which payments towards the cost of the apartment are to be made by the allottees and the date on which the possession of the apartment is to be handed over. The rates of interest payable by the promoter to the allottee and the allottee to the promoter in case of default or delay, must also be mentioned in the agreement.
