A lot of veterans assume the VA system just screwed them. They think: “The VA doesn’t care.” “They’re trying to deny everyone.” “The system is rigged.” Some parts of the system are broken. But most denials happen because the evidence wasn’t packaged in a way the VA rater can actually use. The system only sees what’s documented. Diagnosis alone isn’t enough. Treatment alone isn’t enough. The evidence has to line up with the rating criteria. That’s where most vets go sideways. Save this if you’re fighting a denial.

A veteran sees two issues marked as “conceded” on a closed VA claim and wonders what the next step should be. First, it’s important to understand what VA means by “conceded.” VA usually concedes one or more of the three required elements of service connection: 1️⃣ Something happened in service 2️⃣ You have a current disability 3️⃣ A nexus linking the two If VA conceded two of those elements—most commonly the in-service event and the current diagnosis—that’s actually good news. It means you no longer need to prove those parts. What you should focus on now: • Identify what VA did NOT concede (almost always the nexus) • Read the decision carefully to see why VA says the claim fails • Build your appeal or supplemental claim only around the missing element That usually means: • A strong medical nexus opinion • Or additional evidence addressing exactly what VA said was lacking Bottom line: When VA concedes parts of your claim, they’ve narrowed the fight for you. If you’re rated 100% Permanent & Total, does having conditions marked “static” actually give you any advantage? Short answer: Yes, it does—but with limits. What “static” helps with: • VA generally should not schedule future C&P exams for static conditions • It provides extra stability because VA assumes the condition won’t improve • It reduces routine reexaminations unless something triggers a review What can still trigger a new exam: • Filing for a new condition • Requesting an increase • Filing a secondary claim tied to an existing condition Even though VA isn’t supposed to reevaluate unrelated conditions, in practice, filing new claims can open the door for VA to look at the whole file again. Bottom line advice many veterans follow: If you’re already maxed out, stable, and not missing out on additional benefits, it may be wise to leave things alone and live your life.
