Article 5: Citizenship at the Commencement Article 5 of the Constitution of India defines who became a citizen of India on 26 January 1950, when the Constitution came into force. It clearly states that a person was considered an Indian citizen if: • They were born in India, • OR either of their parents was born in India, • OR they had been residing in India for at least 5 years before the Constitution started. This Article was extremely important because India had just gone through Partition. There was confusion, migration, and emotional division everywhere. But the Constitution did not decide citizenship based on religion, caste, or language. It decided based on legal connection — birth, parentage, and residence. Article 5 laid the foundation of legal identity in India. It shows that citizenship is a constitutional matter, not an emotional debate. Before arguing about who is Indian, understand how the Constitution originally defined it.
