In a HUGE ruling, the DC Appellate court said President Trump does not have the legal authority under the International Emergency Economic Powers Act (IEEPA) to impose sweeping global tariffs or even the so-called “reciprocal tariffs.” The ruling upholds the same ruling issued by the Court of International Trade earlier this year. In a 7-4 ruling, the majority of the court said tariffs are a tax and the US Constitution says the only branch of government allowed to impose taxes is the legislative branch. NOT the executive branch. Trump has already blasted the ruling and has vowed he will appeal to the Supreme Court. The appellate court says the tariffs will be allowed to stay in place while Trump goes through the appeals process. #tariffs #presidenttrump

Alina Habba resigned as acting U.S. attorney for New Jersey after an appellate panel last week upheld a federal court's ruling disqualifying her from the position. That ruling said that Habba's appointment violated a statute specifically governing vacancies in U.S. attorney positions and that the attorney general could not circumvent the statute, either under the more general Federal Vacancies Reform Act or by designating Habba a "special attorney" under a third statutory provision.
