When a soldier serves the nation, his rights cannot be time-barred. 🇮🇳 In Union of India v. SGT Girish Kumar, the Supreme Court of India made it clear — disability pension is not a charity, it is a vested legal right. Arrears cannot be restricted to just three years. Eligible ex-servicemen are entitled to full arrears from 01.01.1996 / 01.01.2006 with 6% interest. This is a “Judgment in Rem”— it applies to all similarly placed soldiers. Based on the Union Budget 2026-27 presented on February 1, 2026, the Indian government has announced significant changes to the income tax exemption on disability pensions for armed forces personnel.  Here are the key details: Change in Tax Exemption: The budget proposes that the income tax exemption on disability pensions will henceforth be restricted to only those personnel who were "invalidated" out of service due to a bodily disability attributable to or aggravated by military service. Impact on Superannuation: Personnel who retire after completing their full service tenure (superannuation) with a disability will no longer be eligible for this tax exemption. Effective Date: These changes take effect from April 1, 2026, applying to the tax year 2026-2027 and subsequent years. Scope: The new rules apply to the Army, Navy, Air Force, and, for the first time, to paramilitary personnel. Veterans' Reaction: Military veterans have heavily criticized this move, arguing that it creates two classes of disabled soldiers, undermines morale, and constitutes a "tax on injuries".  Contextual Factors: Previously, the entire disability element of the pension was exempt, regardless of whether the personnel was invalided out or retired normally. The government has maintained that this change aims to target benefits specifically at those whose service was cut short due to a disability, rather than those who completed their full service.
