You are looking at someone who would not have graduated high school without the protections of the 504 Act, granting me access to an Individualized Education Program, which accommodated my disability. I was constantly in and out of the hospital, and when everything was stripped from me, I still had access to education. Without the 504 Act, I wouldn’t be an honors student in college with 3 associate degrees headed into my bachelor’s program. . These accommodations are under threat. Nearly all of the Special Education staff at the Department of Education have been laid off, meaning that there is no oversight for special education services being honored for students. The current presidential administration is following through firing federal workers during this government shutdown and disabled people are getting the brunt of it. If a school fails to meet accommodations for a student who is disabled, there is no checks or balances to correct this. If I enter a classroom and I don’t receive my testing accommodation, I could fault out of school. If I enter a class room and I do not have accommodations for my seating, I cannot properly do a lab or hands on class and will fail out of school. If I do not have accommodations for using the restroom, I cannot attend school. By restricting access to education, we are only creating a system where people have to rely MORE on government services because they don’t have equal access to school or job opportunities. Maybe you’ve thought to yourself- “Other people are taking action so I don’t need to” or “I’ll do it later” or you’re nondisabled and you thought to yourself, “Oh wow that’s horrible” but you didn’t do anything. This video is your homework assignment. I want you to take action, yes you. Don’t put it off. Don’t assume others have got it. This will take ALL of us. These protections were hard won. The 504 sit-ins in the San Francisco federal building lasted 28 days in 1977. The disability community needs you- yes YOU. Here’s what I want you to do. In the lawsuit known as Texas v. Becerra, 17 states* are looking to ensure that gender dysphoria does not qualify as a disability under the rule. The states clarified that they never intended to throw out Section 504 entirely, and that disability rights would still be protected - they only wanted gender identity disorders to be removed from the law. Tomorrow was the deadline for legal briefs to be submitted, but with the new administration signing an executive order to remove the “gender identity disorder” clause from Section 504, the case is currently on hold. However, excluding certain groups from protections under the law is still problematic and harmful. It is important to advocate for disability rights for all who identify as disabled and/or need the accommodations.
