I want to talk about something that deserves our attention — not panic, not noise, just awareness. Section 504 of the Rehabilitation Act is a federal civil rights law that protects disabled people from discrimination in programs that receive federal funding. That includes protections that help disabled people live in their communities rather than institutions. Right now, nine states are suing the federal government over how these protections are enforced. Let’s talk about one of the most common, and most misunderstood, issues I see: A school withholds recess. But this time… it doesn’t just violate one rule. It violates three at the same time. When recess is written into a 504 Plan as an accommodation Recess is no longer a “privilege.” It is a legally required support for the student to access education. That means: •It cannot be taken away for behavior •It cannot be withheld for unfinished work •It cannot be used as punishment Doing so = failure to implement the 504 plan, which is disability discrimination under Section 504. When state law protects recess Many states now have laws requiring daily recess and limiting or prohibiting withholding it for discipline or academics, especially for elementary students. So now we’re not just looking at a 504 violation. We’re looking at a state law violation too. When district policy also prohibits withholding recess Most districts have written policies stating recess cannot be withheld for: •incomplete work •behavior •punishment So when a school still does it? That is a direct violation of their own policy, the very rules they are required to follow. Withholding recess in this situation can simultaneously violate: • The student’s 504 plan (federal disability law) • State law protecting recess access • The district’s own board policy That’s a triple violation. And here’s the key reminder: Accommodations are not optional. State law is not optional. District policy is not optional. If recess is required for that student to regulate, attend, and access learning taking it away isn’t discipline.
